Can an employer require for me to take my annual leave during the notice period?
The employer may, after consulting the employee and in accordance with the notification procedure laid down in the Annual Holidays Act, require that the annual leave from the most recently ended holiday credit year are taken during the notice period. This applies to summer holiday in so far as the period of notice falls in the holiday season (between 2 May and 30 September) and other holiday in so far as the period of notice falls between 1 October and 30 April. On the other hand, the employer cannot require new holidays accruing during the current holiday credit year to be taken during the notice period. These holidays but must be agreed separately.
However, the employer and the employee can agree that the employee takes the annual holidays accrued during the recently ended holiday credit year and the current holiday credit year during the notice period. The agreement should be concluded in writing for the sake of legal protection of the parties.
